H2B Work Visa Requirements & How We Can Help
Seasonal, non-agricultural workers, both skilled and unskilled, may apply for a H-2B Work Visa to the United States. Workers must have a job offer in place for a job that has a shortage of workers available or willing to work in the United States. Workers must be able to demonstrate that they intend to return home after the completion of the job, once the duration of the permitted stay has expired.
H2B visas are used for a variety of worker types including entertainers, athletes, business trainers, camp counselors, ski instructors, healthcare givers, landscaping, forestry, housekeeping, and many more.
The H2B Visa cardholder may bring along their spouse and children (as long as they are unmarried and under the age of 21) but the Visa does not allow dependents of cardholders to work while they are in the U.S.
The initial H2B Work Visa is good for one calendar year. The work Visa may be renewed at the request of the employer as long as they are able to again demonstrate that the worker intends to return home upon completion of the job. Visas can be considered for a one year extension, not to exceed three years.
Who is Eligible for an H2B Visa?
The Employer must:
Have a seasonal, one-time, intermittent, or peak-load job need
Have an unfilled job under 1 year in length
There must be no willing, qualified U.S. candidates available for the job
The Employee must:
Have a valid job offer to do seasonal or temporary work
Have the correct background and experience to complete the job
Intend to return home before the work visa expires
Does your medium-sized or large business meet qualifications to begin seeking seasonal workers or laborers outside of the country?
Have you already posted positions and sought employees inside of the United States?
If you have found no adequate candidates your next step will be to your local state workforce agency (SWA) for a temporary labor certification.
The SWA will transfer the case to the U.S. Department of Labor for a final decision on the labor certification.
